New Orleans Dec. 9th 1842

Majr. James T. Gleaves
Dr Sir – I have this morning recd a letter from my mother stating that her negroes have been taken from her but did not state by whom or for what purpose presuming that you would not permit any illegal steps to be taken with regard to her property I have felt myself satisfied until I recd her letter of the 12th Novr. stating that they were to be hired out on the Monday following which would be Court day – She further informed me that there was Suits entered against me in Chancery Court for a Considerable amount but did not state by whom I know of nothing against me there that is legal you informed (me) that Shepherd Brown had ordered Suit against me as endorser for Holt which Suit I directed to be defended and the Courses to puresue Brown is trying to take the advantage of me and he knows it will (well) but he will be defeated in his object Certain if you have any Claims against me your self for funds advanced or trouble you have taken please let me know it and I will remit you the money -

I do hereby authorise you to deliver all the property that I have any interest in whatever from the estate of my Father to my Mother or her authorised agent and further I do hereby release you from all liabilities to me as one of the heirs at law of the late Randel Rutherford Decd by delivering the property requested & further it is my wish that you should not with hold anything that I may be interested in from my Mother Polly Rutherford either directly or indirectly but deliver the property to her particularly the slaves mentioned in the will of my Father and take a schedule of the same from her or her agent as the case may be of the property delivered with a receipt attached to it for my benefit the receipt and schedule of the property you Can retain with this letter untill settlement with me in complying with this authority you will notify me the course that you have taken and send me a copy of my Fathers will and a schedule of the property delivered to my Mother or agent that I have any interest in if this should not be sufficient authority for you deliver her the property let me know what course to pursue that she may recover those negroes mentioned in the will

of my Father I shall be in New Orleans for the next six months you can direct any communication to me here I presume the foregoing authority is sufficient guarantee to you to Comply with the same

Transcriber Notes

Court Day was usually held throughout the South on the first Monday of each month. Not only was court in session, but the day was given over to the outdoor sale and hiring out of slaves, and the sale of produce and merchants' wares.
